TERMS & CONDITIONS FOR THE LEARNING OF COURSES
AT  TULIP INTERNATIONAL, MUMBAI


Please read the following terms and conditions carefully. The use of our services and admission to our courses & programs is subject to your compliance and acceptance with the following statements. Once you subscribe or use any of our services or take admission to any of our courses or programs, you agree that you have read and understood the terms and conditions and ready to be bound by the below statements. Note: In these Terms, references to 'you', 'your', 'user' shall mean the end user accessing the website of or doing any course or program of TULIP INTERNATIONAL, and 'we', 'us', 'our', 'Company', ‘Institute’ shall mean TULIP INTERNATIONAL, and references to ‘website’ shall mean the websites tulipinternational.net and www.tulipindia.net, and ‘student’ shall mean any person enrolled for any course whether in online or classroom mode with TULIP INTERNATIONAL.

GENERAL

The websites tulipinternational.net and www.tulipindia.net are owned and operated by the Company. Use of the website is subject to your acceptance without any modifications to all the terms and conditions made by the Company. The website tulipinternational.net hosts an e-learning LMS (Learning Management System), the use of which amounts to complete acceptance of the terms & conditions of the Company.

USER WILL AGREE TO THE TERMS & CONDITIONS AND PRIVACY POLICY OF THE COMPANY BY:

  1. Using the services and facilities provided by the website and the institute in any way.
  2. Browsing the content on the website.
  3. Enrolling for any course or program of the institute.

The Company shall not be required to notify you about the modifications made in the terms; the revised terms should be determined by checking the website on a regular basis. Use of services and facilities on the website is subject to the current version of the policy, hence to know about any updates in the policy shall be the sole responsibility of the user.

SERVICES
  1. Tulip International provides an Internet based platform to host Healthcare and Cosmetology e-learning courses on their website which are designed for the knowledge- enhancement of the student. Registration for the same can be done either through the website or in- person at the Company office.
  2. Tulip International imparts classroom training of Healthcare and Cosmetology courses which are designed for the knowledge- enhancement of the student. Registration for the same can be done either through the website or in- person at the Company office.

Admission once taken is not cancelled or transferred and no refund of fees paid is possible for any reason.

 

ELIGIBILITY TO USE

According to the Indian Constitution, a person under the age of 18 is minor. Services, courses and facilities offered on our website shall not be available for minors. Please note, if you are living outside of India then it's your responsibility to make sure whether you are eligible or not for our services. Persons barred under the laws of India are not permitted to use our services. The Company reserves the end right to reject or grant the access to a new user or terminate the access of existing users, at any time. Also, the Company shall not be required to furnish any reason for it.

The contents and course information displayed on the website & prospectus are not to be construed as an ‘Offer ‘and are merely an ‘Invitation to Offer’.

Invitation to Offer of getting one or more courses free with a specified course is only applicable when the enrolment is done in all the applicable courses together. This applies even if only the registration fee is to be paid for the free course.

USER ACCOUNT, PASSWORD & SECURITY

The website registration process enables a user to access the services. Certain user information is required to create an account at our website. It is the sole responsibility of the user to maintain the confidentiality of the User Id and Password received upon completion of the registration. Users are also responsible for any activity occurred under the account, thus make sure to exit at the end of each session to prevent unauthorized access of your account or breach of security. The Company shall not be responsible for any loss or damage emerged if you fail to obey the terms. User is responsible for the validity of account information provided during the website registration process. In case of submission of untrue, incomplete or inaccurate information, the Company has the end rights to suspend or terminate your account. The User Id and Password granted by the Company to the User is to be utilised for access to the e-learning portal throughout the learning period from one fixed device (e.g. Laptop, PC or Mobile) only in 21 successful login attempts each month. User is responsible for ensuring that the User Id and Password granted by the Company to the User is not shared to any Third Party or accessed from any other alternate device. Failure to comply with the same will result in the immediate discontinuation of the course without any explanation and no refund of course fees to any extent will be granted.

USER OBLIGATIONS

  1. Your access to the website is a non-exclusive limited privilege, which is subject to compliance with the Terms of Use.
  2. The Services, Website and the materials offered to a user can only be used for purposes that are permitted by: (a) the Terms; and (b) any applicable law, regulation or relevant jurisdictions.
  3. You agree to adhere to the limitations on circulation, use and reproduction of any material accessed from us in accordance to the Terms mentioned in the 'Use of Material' section and ‘User Account, Password & Security’ section.
  4. You agree not to access the website, the material, the courses or the services through any other interface, which is not provided by the Company. Use of deep-link, robot, spider or other automatic device, program, algorithm or methodology, or any other similar process to access or attempt to access the website or content (or any portion thereof) is strictly prohibited.
  5. The Company does not host any indecent, offensive or otherwise objectionable content on the website. The Company disclaims all the liabilities arising in relation to any offensive, indecent or otherwise objectionable content that may be exposed to a user through any external malicious third party link while accessing the website.
  6. The content posted or uploaded on the website by the user or any third party should not be offensive and should be in accordance to the applicable laws. Users are legally liable for the content they post. Hence you accept not to: a) Discredit, harass, abuse or violate the legal rights b) Impersonate any person or entity, or misrepresent your affiliation with a person c) Publish, post or distribute any inappropriate, defamatory, obscene, indecent or unlawful material or information d) Upload the files, software or other material protected by intellectual property laws that are not owned by you e) Upload files containing virus or similar program that may damage the website f) Undertake any activity that disrupts the website, the servers or networks connected to the website g) Seek unauthorized access to the system or network or to any server of the website, or any attempt to gain access via illegitimate means such as hacking h) Scan the vulnerability or breach the authentication measure of the website or networks connected to the website i) Harm the website, resources, accounts, servers, networks connected to the websites, or any links affiliated to it j) Collect or share data about other users k) Use of any device to interfere the working of the website l) Use of the website content or material that is unlawful. Or to practice any illegal activity that violates the rights of the Company m) Conduct surveys, pyramid schemes, contests or chain letters n) Download files of another, users posted on the website that is illegal to be distributed in such manner; o) Delete any author attributions, legal notices, proprietary designations, labels of the origin of the software contained in the uploaded file p) Infringe code of conduct applicable for to or any particular service q) Breach applicable laws or regulations in force within or outside India and r) Reverse engineer, copy, dispense, exhibit, reproduce, publish, license, transfer or sell any information acquired from the Website.
  7. You agree that you are solely responsible for any loss or damage or any breach of your obligations under the terms.
  8. Your Admission to the Online and Classroom courses of the Institute is governed by the Institute’s Student Code of Conduct. The student is required to observe and follow the same diligently. Violation of the Code will attract penalties on the student as the Institute deems fit.
  9. Use of mobile phone cameras, cameras, video cameras and audio recordings are strictly prohibited in all lectures.
  10. All products, materials, tools, machines, instruments, & supplies provided or shown in lectures are for use in the lectures only and are not samples or take-aways.
  11. It is the responsibility of the student to be punctual in attendance to lectures. The Institute is not responsible for cover-up or repeat of lectures in which the student remains absent.

 

USE OF MATERIAL

  1. The Company grants you a non-transferable right to access the courses or any other material available on the website. In accordance with the terms, you may: a)Access the material for personal learning purposes b)Not alter the material available on the website c)Not remove any copyright or proprietary notices available on the website.
  2. The contents, design, layout and look, feel of the website are protected under Intellectual Property Rights, thus copying of the same shall not be granted here in and is a punishable offence under Indian laws.
  3. Unless permitted by the Company in writing to the user, users are not allowed to download or install any of the software available on the website.

USAGE CONDUCT

  1. Basic requirements to access and transact on the website, such as computer and Internet connection, shall be the sole responsibility of the user.
  2. The website should be used for sensible purpose only, users shall not indulge in activities that are not foreseen by the company.
  3. Loss or damage arising out of decaf authorization for a transaction shall not be the liability of the Company.

 

INTELLECTUAL PROPERTY RIGHTS

  1. The website content is protected under Copyright, Patent and Trademark laws (Intellectual Property Rights).
  2. Users are not allowed to use the logos, service marks and trademarks displayed on the website.
  3. The company owns the trademark, domain name, including all rights related to patents, utility models, trade secrets, source code, meta tags, databases, text, content, graphic, icons, and hyperlinks.
  4. You admit that you shall not copy, republish, post, reproduce the content from the website without obtaining permission from the Company of the same.
  5. Unauthorised reproduction, transmission or distribution of the contents of the courses and the website by the users including user login credentials is illegal and reportable to cyber crime authorities for appropriate prosecution under Indian laws and Intellectual Property Rights. Any attempt by a user to steal/copy/distribute the contents and material hosted on the website or otherwise provided to the user through any other mode of delivery will result in the user being prosecuted under the applicable national and international copyright laws. Convictions under criminal/civil copyright infringement, including infringement without monetary gain may include jail term and/or severe fines for each instance of copyright infringement.

DISCLAIMER OF WARRANTIES AND LIABILITIES

  1. We make sure that all the information posted on the website is correct, however the Company never warrants the accuracy, quality and completeness of data, product, and services. The Company shall not be liable for any direct, indirect, incidental or consequential damages caused by:
  2. The use or inability of use of services;
  3. Unauthorized access to the user's data; and
  4. Any matter related to the services.
  5. The Company shall not be liable for delay or inability to use of the website or services, or any information, software and graphics acquired through the website. Further, the company is not responsible for non- availability of the website during periodic maintenance or accidental suspension caused due to technical reasons.
  6. You acknowledge that data obtained from the website is done entirely through your wisdom. Thus, you agree that you will be responsible for any damage and loss caused to your computer with such data.
  7. The institute is liable to provide login access to the Online course(s) on realization of complete course fees from the student. However, the institute is not liable if, after provision of login access credentials, the student fails to login to his/her Online course(s) within the applicable time frame. No extension of time frame for course completion or refund of fees is possible and requests for the same will not be entertained.
  8. The institute is not liable to cover-up or repeat any classroom lectures in which the student remains absent. Requests for attendance of missed lectures with the next batch or refund of course fees will not be entertained.
  9. The Institute holds no responsibility for any kind of misconduct, unprofessional behaviours, quackery, treatments, consultations, false commitments, promises etc made by the student to his/her patient or client or any person concerned in his/her professional practice.
  10. The Institute merely imparts knowledge of Healthcare &/or Cosmetology subjects to the student during his/her course training with the sole aim of educational development & knowledge-enhancement of the student.
  11. Limitation of Liability- In no case shall the Company, its directors, owners, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or doing of any course or program, or for any other claim related in any way to your use of the service or from doing any course or program, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, or from the doing of any course or program, even if advised of their possibility.

FORCE MAJEURE

We shall not be liable to you in respect of any delay in performance of these terms and conditions or delay in performance or breach of the terms and conditions due to any event or circumstances beyond our reasonable control.

VIOLATION OF THE TERMS OF USE

The Company, in its sole and absolute discretion, may terminate the access to the courses of any user in case of violation of the terms or additional terms. You consent to the injunctive or equitable remedy taken by us after the contravention of the terms of use that causes loss to the Company.

You agree to indemnify and hold harmless Tulip International, its affiliates, directors, employees from and against any and all losses, liabilities, damages, claims and expenses incurred by the Company that emerged of infringement, non-performance of any warranty or obligation performed by you.

Further, you agree to hold the Company harmless against any claims made by any third party due to your use of the website that caused damaged to a third party. The Company will also be entitled to redeem from you and you agree to pay any cost and fees of such action.

CLOSING YOUR ACCOUNT ON OUR WEBSITE

Tulip International at its sole and absolute discretion may terminate the usage by the User with or without cause at any time if:

  1. Terms, conditions or any policy of the Company, applicable to you is violated.
  2. The provision of the services to you becomes unlawful.
  3. The provision of the services to you is no longer commercially viable.
  4. The Company chooses to discontinue the access to the website, in general or specifically, for you.
  5. Termination or suspension due to technical reasons may include, removal of access to the website, deletion of user material (including files and material of user with account information), exclude you from accessing our website.
  6. The Company shall not be liable to any third party for such termination. You acknowledge that termination shall not affect your liabilities and obligation.

REPORT ABUSE

As per terms, users can be held legally liable for every content or material posted on the website, and legally accountable if the content or material is defamatory or protected by copyright and trademark. PRIVACY POLICY

You accept that you have read and fully understand the privacy policy of the website, further you agree that the terms and conditions of the policy are acceptable to you. Newsletters and Communication: You agree to receive communication and newsletters via SMS, Whatsapp or Emails from the Company.

To avail certain services or for course registration on our Websites, users are required to provide certain information for the registration process namely: - a) your name, b) email address, c) sex, d) age, e) PIN code, f) credit card or debit card details etc., and / or your occupation, interests, and the like.

The Information as supplied by the users enables us to improve our sites and provide you the most user-friendly experience. Such information will not be shared with any third party by the Institute.

All required information is service dependent and we may use the above said user information to, maintain, protect, and improve its services (including advertising services) and for developing new services.

Such information will not be considered as sensitive if it is freely available and accessible in the public domain or is furnished under the Right to Information Act, 2005 or any other law for the time being in force.

By providing us your Information or by making use of the facilities provided by the Website, You hereby consent to the collection, storage, processing and transfer of any or all of Your Personal Information and Non-Personal Information by us as specified under this Privacy Policy. You further agree that such collection, use, storage and transfer of Your Information shall not cause any loss or wrongful gain to you or any other person.

GOVERNING LAW

You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Mumbai in all disputes arising out of or relating to the use of the Institute’s Sites/Services/Courses. Only Indian Law will be applicable.

SEVERABILITY

Each of the provisions of these terms and conditions shall be separate and severable. Should any provision be invalid or unenforceable, it shall be severed from the terms and conditions, and the remaining provisions of these terms and conditions shall continue in full force and effect and be amended so far as possible to give valid effect to the intentions of the parties under the severed provision.

 

NO PARTNERSHIP

Nothing in this Agreement shall operate so as to create a partnership, joint venture, an agency relationship or employment of any kind between you and us. All rights not expressly granted herein are reserved.
CHANGES IN TERMS AND CONDITIONS

If we decide to change these Terms & Conditions, we will post the revised Terms & Conditions on our Web Site. We may change these Terms & Conditions at any time without prior notice.

REFUND AND CANCELLATION POLICY

Admission once taken cannot be cancelled or transferred. No refund of fees is possible for any reason whatsoever.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless the Institute and its affiliates, subsidiaries, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

GENERAL

  1. The Institute reserves the right to refuse any admission or registration to any of its courses and services.
  2. The Institute reserves the right to disqualify a candidate for providing false information, submitting improper documents or for misconduct in a particular course, total course fee will be forfeited in such a case.
  3. Diploma certificate would be awarded only after payment of full applicable course fees & exam fees, and on successfully completing the course and passing the Diploma exams. Minimum passing marks is 50%.
  4. The Institute reserves the right to revise / change the curriculum, the course structure or course delivery methodology without prior notice.
  5. There shall be a minimum batch size to a program. In the event of the batch size being below the minimum number, program shall be moved to next batch.
  6. The courses offered are teaching and educational programmes, and are not a license to practice. They do not qualify you as a doctor or physician.
  7. Placement assistance is a facility provided by the Institute and placements are not guaranteed to any student. Placement assistance will be provided for a period of 01 year from the date of successful completion of the course and passing its examination. Any student interested in obtaining placement assistance has to contact the student helpline email address of the Institute for the same.
  8. Your admission is not an ‘Open’ admission and is valid only for the applicable course duration. The admission will expire after the applicable course duration. A request to extend the admission may be made to the Institute via email. The Institute may accept the request to extend the admission at its sole discretion and the Institute reserves the right to refuse extension. Re-registration & extension fees will be applicable if the request is approved by the Institute.
  9. Course fees are inclusive of all taxes. Examination fees are levied over and above the course fees. Examination fees are payable by the student only at the time of making an application for appearing for the Diploma examinations.
  10. The Institute may give an option to the student to pay the course fees in 2 instalments with applicable instalments fees, at its sole discretion.
  11. Examination- The student has to appear for the Diploma exams with his/her batch only. If the student misses/ remains absent for the exam with his/her batch, he/she can apply for giving the exam with the next batch on payment of exam extension fees. The institute’s examiners’ assessment is final and binding on the student. The institute adopts a ‘Zero Tolerance’ policy for misconduct or malpractices during examinations and may debar the student from appearing in any of the examinations.
  12. Registration for a course is valid for 1 year. Renewal for a course is Rs 590/- per year on yearly basis. Renewal of the course can be done for a maximum period of 03 years, post which the admission to the course stands expired.
  13. Batch transfer- Batch Transfer Fee: 1890/- to transfer booking from admitted batch date to a later batch date. Applicable if informed at least 2 days before batch start date and not on the same day or after the batch starts.
  14. Absenteeism- Institute is not responsible for cover-up of the student’s missed classes for whatever reasons. Admission to any course is given for a specific Batch Date. It is not an ‘Open’ admission. The course training has to be completed within the specific course duration for the opted batch only. The student can Re-attend the missed class with the next batch, if desired, by paying only 33% of the session fee on Pro-rata basis, provided the course, portion exists and at the discretion of the institute.
  15. Instalment Facility (For Classroom Mode Only):
  16. a) Fees can be paid in 2 instalments of 2 or 3 weeks apart, depending on the duration of the course.
  17. b) One time Instalment Fee payable with 1st instalment is as under:

Rs. 490/- for an instalment amount up to Rs. 10,000/-,

Rs. 990/- for an instalment amount between Rs.10,001/- to Rs. 20,000/- and

Rs. 1890/- for an instalment amount above Rs. 20,000/-.

  1. c) Payment of Instalments to be done on or before the due date (as agreed and mentioned on the I-Card). Delayed payment would call for immediate discontinuation of the course(s) till the dues are cleared.

LATE FEE: Late payment of instalment, if permitted, irrespective of the classroom presentee is applicable as under:

Rs. 300/- per week for instalment up to Rs.10,000/-,

Rs. 500/- per week for instalment between Rs.10,001/- to Rs.30,000/- and

Rs. 700/- for instalment above Rs. 30,000/-.

  1. Cheque Bounce Charge: Rs.500/-. And no further cheques will be accepted form the concerned student.
  2. Examination: a) Exams are conducted in 2 methods - Classroom AND Online. The fee for the different courses is: For Healthcare courses- Rs. 1290/- per course/subject, For Cosmetology courses- Rs. 1490/- per course/subject. To be paid only at the time of application for the examination. b) Examination Time Table is displayed 2 to 3 weeks prior to the examinations. c) Examination is held four times a year- tentatively in the months of January, April, July, October. Examinations would be held on any day of the week at the discretion of the institute. d) 75% attendance is compulsory for appearing Final Examination. e) Passing percent is 50% marks. The examiner’s assessment is final and abiding on the student.
  3. Exam Extension Fee:
  4. a) Admission to any course is done for a specific Batch Date. It is not an ‘Open’ admission. The examination has to be given along with the same batch on its announced examination date. b) If the student cannot give the examination with the opted batch, and wishes to give the examination later then an Extension has to be taken. The extension is from the Start Date of the opted batch for a period of 1 year. The examination has to be given within this extension period. c) The Extension Fee is per

year on yearly basis:

Rs. 890/- for course fee up to Rs. 25,000/-,

Rs. 1290/- for course fee between Rs. 25,001/- to Rs. 40,000/- and

Rs. 1890/- for course fee above Rs. 40,000/-.

  1. Results And Certificate:
  2. a) Exam results are declared approximately after 3 to 6 weeks.
  3. b) Only successful students will be issued Certificate(s).
  4. c) ‘Certificate of Attendance’ available on attending the course, without giving / passing exams. Fee: 1890/- per course.
  5. d) Duplicate Certificate Fee for Diploma is Rs. 2490/-.
  6. Identity Card: a) It is required for attending your classes & examination. b) Duplicate I-Card: Rs. 100/-.
  7. Course Repeat: The student can repeat the full course with any further batch by paying only 33% of the latest course fee, provided the course, portion exists, at the discretion of the institute.
  8. Duplicate Course Notes: Duplicate set of full course training notes can be obtained for Rs.1990/-.
  9. For functional and administrative reasons, Batch Time, Centre may be changed, if found necessary.
  10. The institute reserves the right to change/ modify the course curriculum any time. It will be abiding on the student to undergo training with the modified curriculum.
  11. The institute will communicate/ deal only with the adult student directly, nobody else on his/her behalf.
  12. Rules herein are subject to change without prior notice and abiding on all the students, past and present.
  13. Disputes, if any, subject to Mumbai Jurisdiction.

 

SHIPPING POLICY

The physical coursebooks of the Online courses are shipped to the address filled by the student in the Admission details. Following are the terms and conditions that constitute our Shipping Policy.

(A) For DOMESTIC Shipping:

For addresses in India, the shipment will be sent by either DTDC or IndiaPost (SpeedPost).

Shipping Costs: No additional shipping cost is collected from the student for one-time delivery within India. If the shipment comes back to the Institute for any reason, the Institute reserves the right to levy applicable shipping charges to re-deliver the same package to the student within India again.

Estimated Delivery Time: Delivery within India usually takes around 2-10 working days depending on the delivery volume load on the shipment carrier.

Customs, Duties & Taxes: The Institute is not responsible for any customs or other duties/taxes applied to your shipment. All fees imposed during or after shipping are the responsibility of the student (tariffs, taxes etc).

Damages: The Institute is not liable for any products/documents/books damaged or lost during shipping. The responsibility of the Institute ends at the point of handing over your package to the shipment carrier for shipping. If you received your shipment damaged, please contact the shipment carrier to file a claim. Please save all the packaging material and damaged items before filing a claim with the shipment carrier. 

 

(B) For INTERNATIONAL Shipping:

For addresses outside India, the package will be shipped by either FedEx or IndiaPost. The student will be given the choice to select the shipment carrier. The package will be shipped only by the carrier selected by the student.

Shipping Costs: The applicable shipping cost is collected from the student for one-time delivery outside India. If the shipment comes back to the Institute for any reason, the Institute reserves the right to levy applicable shipping charges to re-deliver the same package to the student outside India again.

Estimated Delivery Time: Delivery outside India usually takes around 7-20 working days depending on the delivery volume load on the shipment carrier and the destination country of the student. For faster delivery, the student is advised to select FedEx as the shipment carrier.

Customs, Duties & Taxes: The Institute is not responsible for any customs or other duties/taxes applied to your shipment. All fees imposed during or after shipping are the responsibility of the student (tariffs, taxes, insurance etc).

Damages: The Institute is not liable for any products/documents/books damaged or lost during shipping. The responsibility of the Institute ends at the point of handing over your package to the shipment carrier for shipping. If you received your shipment damaged, please contact the shipment carrier to file a claim. Please save all the packaging material and damaged items before filing a claim with the shipment carrier. 

PAYMENT METHODS

The Institute accepts fees through the following payment channels: Cash, Cheque, Bank Transfer, UPI.

The Institute has tied up with Paytm to embed a Payment Gateway and accept payments through its payment gateway via Debit Cards, Credit Cards, UPI, Netbanking, Paytm Postpaid etc.

The Institute as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction or error in processing of any transaction initiated through any third party payments channels including but not limited to Banks, NPCI & Paytm.

 

STUDENT CODE OF CONDUCT

Introduction

Tulip International has been established to make significant contribution to Healthcare and Cosmetology education, and we aim to nurture professionals of high calibre with integrity and passion for Wellness.

In keeping with our vision, we have developed guidelines hereinafter referred to as the “Student Code of Conduct” to be followed by our student community with diligence and in full faith during and after their learning tenure with the Institute.

By taking admission for any course/program of the Institute, you agree to adhere to the following Code of Conduct:

 

The Code of Conduct

(1) Maintenance of discipline and good conduct by students:

Every student, during the term of the course, shall be under disciplinary jurisdiction of the Competent authority which shall take appropriate action in case of indiscipline, misconduct on the part of the student.

‘Student’ means and includes the person who is enrolled as such by the Institute. Note: This code extends to any person acting for/ on behalf of the student also.

‘Competent authority’ for the purpose of this code means and includes the Head/ Principal of the Institute and/or any other person vested with the requisite authority by the Head/ Principal.

(2) Obligation of the Student:

Every student, shall at all times:

  1. a) Conduct himself properly,
  2. b) Maintain proper behaviour,
  3. c) Observe strict discipline within the campus of the institution,
  4. d) Ensure that no act of his/ her consciously or unconsciously brings the institute or any establishment or authority connected with it into disrespect.

(3) Any act of a student constitutes misconduct and/or indiscipline, which term shall mean and include, among others, any one or more of the acts done jointly or severally mentioned hereinafter, namely:

  1. a) Any act that directly or indirectly cause or attempt to cause disruption in the lawful functioning of the institution.
  2. b) Habitual un-punctuality in attending lectures, tutorials, practical, and other course as may be prescribed.
  3. c) Repeated absence from lectures, tutorials, practical, and other course as may be prescribed.
  4. d) Securing admission in the institution, to any course or program by fabrication and suppression of facts or information.
  5. e) Obstruction to any student or group of students in his or her legitimate activity within the campus of the institution.
  6. f) Suppressing material information or supply of false information to the institution, for seeking any privilege.
  7. g) Possessing or using any fire arms, lethal weapons, explosive, or dangerous or corrosive substance on the premises of the institution.
  8. h) Possessing or consuming any poison or stupefying drugs or intoxicant in any form at the institution.
  9. i) Ragging, bullying, harassing any student in institution or outside thereof.
  10. j) Indulging in any act as would cause annoyance, embarrassment or harassment to any other student, or staff member or any member of family of the staff, or the Institute as a whole.
  11. k) Indulging in any act of violence, assault, intimidation or threatening (verbal, written or physical) in the institution or outside thereof.
  12. l) Destroying or attempting to destroy or tamper with any official record or document of institution.
  13. m) Conduct unbecoming of the student, at any meeting or special function or activity arranged by the institution or at any other public place or public platform or social media.
  14. n) Stealing or damaging any property belonging to the institution, staff member of the institution or any other student.
  15. o) Instigating violence or participating in any violent demonstration or agitation or violent streak in the institution.
  16. p) Violation of any of the rules and regulation of the Institution.
  17. q) Gambling in any form in the Institution
  18. r) Disorderly behaviour in any form or any act specifically forbidden by the Institution.
  19. s) Conviction, in the court of Law for criminal offence, involving moral turpitude.
  20. t) Levelling baseless allegations and making false statements against the Institute and/or its courses on any public platform or media.
  21. u) Using abusive, inappropriate, offensive or accusatory language against any student, staff member or the Institute as a whole.
  22. v) Any other act not specifically mentioned hereto before which, whether by commission or omission as would in the circumstances of the case be considered by the competent authority as an act of misconduct and/or indiscipline.

 

(4) The Competent authority may impose any one or more of the following punishment/s on the students found guilty of misconduct and/or indiscipline:

  1. a) Warning /Censure/Reprimand.
  2. b) Fine as deemed fit by the Institute.
  3. c) Cancellation of any scholarship/award/prize/medal, awarded to the student by the Institute, with prospective effect.
  4. d) Expulsion from the institute without any refund/ adjustment of fees paid.
  5. e) Debarring from appearing for examination or examinations conducted by the institute, for a specific period, deemed fit by the Institute.
  6. f) Cancellation of the result of the student concerned in the examination the institute, in which he/ she has appeared.
  7. g) Temporary rustication from the institute for a period not exceeding 3 years.

(5) If the Institute is satisfied that there is a prima facie case inflicting penalties, mentioned in Clause No. 4, it may itself or through other person, persons, authorized by it, for this purpose, shall make enquiry, in following manner.

  1. a) Due notice in writing or through email shall be given to the student concerned about the alleged act of misconduct/ indiscipline.
  2. b) Student charged shall be required within 15 days of the notice/ email to write his/her representation about such charge/s.
  3. c) If the student fails to submit his written representation within specific time limit, the Institute reserves the right to levy such penalty as covered in Clause No. (4).
  4. d) If the student does not provide a satisfactory written explanation within the specified time limit, the Institute reserves the right to levy such penalty as covered in Clause No. (4).
  5. e) Provided procedure prescribed above need not be followed in the following circumstance:-
  6. When the student charged admits the charges in writing.
  7. When the order of punishment is to be based on facts which have led to the conviction of the students charged, for the offence involving moral turpitude.

iii. When the student charged has absconded or for any other reasons it is impracticable to communicate with him.

Admission to the Institute’s courses and/ or programs amounts to complete acceptance by the Student of the Institute’s Code of Conduct & Rules and Regulations.
